3. Qualification Process

All potential clients must complete our qualification process before engaging our services. We reserve the right to accept or decline any client based on our internal qualification criteria. Submission of a contact form does not guarantee acceptance as a client.

4. Service Agreements

Specific terms for each consulting engagement will be outlined in separate service agreements. These terms of service govern the general relationship between SpermWhale and its clients, while individual service agreements will detail project-specific terms, deliverables, timelines, and pricing.

SpermWhale's liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages.

9. Service Availability

While we strive to provide continuous service availability, SpermWhale does not guarantee uninterrupted access to our services. We reserve the right to modify, suspend, or discontinue services with reasonable notice to clients.

11. Termination

Either party may terminate the service relationship with 30 days written notice. Termination does not relieve either party of obligations incurred prior to termination. Specific project termination terms will be outlined in individual service agreements.

These terms shall be governed by and construed in accordance with the laws of the State of Texas, United States. Any disputes arising from these terms or our services shall be resolved in the courts of Texas.
